These Terms & Conditions govern your use of The Health Club (https://thehealthclub.in), which is owned and operated by Mosaic Wellness Private Limited (“Mosaic”, “Company”, “we”, “us” or “our”). The Health Club is a marketplace-style platform for products from Man Matters, BeBodywise and Little Joys. All three brands are owned by Mosaic. Unless an order expressly identifies a different seller, a purchase on The Health Club is a transaction with Mosaic; the brands are product lines on the platform, not independent third-party marketplace sellers.

Mosaic’s registered office is at 6th Floor, Thane One, DIL Complex, G.B. Road, Kapurbawdi, Village Majiwade, Thane (West), Maharashtra, India 400610. By browsing, registering or placing an order, you agree to these Terms, our Privacy Policy and our Returns & Refunds Policy. If you do not agree, please do not use the Website.

1. Eligibility and accounts

You must be able to form a legally binding contract under Indian law to transact on the Website. A minor may use the Website only through a parent or legal guardian where permitted by law. You are responsible for accurate account information, keeping access credentials confidential and activity under your account. Tell us promptly of suspected unauthorised use.

We may restrict or suspend access when necessary to protect users, comply with law or address a breach of these Terms.

2. Products, orders and delivery

The Website displays health, wellness, personal care and related products and any services we make available. Product descriptions, prices, availability, offers, delivery estimates and seller details shown at checkout form part of the information for your order. We may correct errors and update listings.

Placing an order is your offer to purchase. An order acknowledgement records receipt of the offer; acceptance occurs when we confirm the order after checking availability and payment, as applicable. We may decline or cancel an order if a product is unavailable, payment fails, information is incorrect or fulfilment would breach law, and will arrange any refund due.

We deliver only to serviceable addresses in India. Delivery estimates may change because of logistics or circumstances outside our control. You must provide a complete and accurate delivery address and be available to receive the order.

3. Prices, payments and offers

The price, taxes, delivery charges and available payment methods are shown at checkout. Payment processing may be performed by third-party providers under their terms. Promotional offers and coupons are subject to their stated conditions and may not be combined unless expressly permitted.

If an obvious pricing or listing error affects an order, we may contact you to confirm the correct details or cancel and refund the order.

4. Cancellations, refunds and replacements

Our Returns & Refunds Policy at https://thehealthclub.in/refunds-policy governs order cancellation, refund timing and replacement requests. In summary, an eligible order may be cancelled before delivery; routine returns after delivery are not accepted; and wrong, missing, damaged or expired products may qualify for replacement when reported within 7 days of delivery. Your rights under applicable law remain available.

5. Product information and health matters

Product information on the Website is for general information. Read the product label, directions, warnings and ingredients before use. Content on the Website is not a substitute for advice from a qualified medical professional. If you have a medical concern, are pregnant or nursing, take medication, or are buying for a child, seek appropriate professional advice before using a relevant product.

6. Acceptable use

Use the Website only for lawful personal purposes. Do not impersonate others, misuse accounts, infringe others’ rights, submit defamatory or unlawful content, transmit malicious software, interfere with the Website or another user, probe security, access accounts or data without permission, scrape or copy the Website without permission, or resell products purchased for personal use in breach of applicable offer terms.

If the Website permits reviews or other submissions, you are responsible for what you post. We may remove material that violates these Terms or applicable law and may report unlawful activity to appropriate authorities.

7. Content and intellectual property

The Website’s content, design, software and branding, including The Health Club, Man Matters, BeBodywise and Little Joys names and marks, belong to Mosaic or its licensors and are protected by applicable intellectual property law. You may view Website content for personal use. You may not reproduce, distribute, modify or commercially use it without written permission.

If you submit a review or other content, you confirm you have the right to submit it and grant Mosaic a non-exclusive right to display and use it in connection with the Website and its products, subject to the Privacy Policy. We may remove content that violates law or these Terms.

8. Third-party services and links

Payment, delivery and other support services may be provided by third parties. The Website may link to external sites. Their separate terms and privacy policies may apply. References to outside services do not make those providers the seller of Mosaic-owned brand products sold on The Health Club.

9. Privacy and communications

Our Privacy Policy explains how Mosaic processes information on the Website and across the Mosaic-owned brands listed above. We may contact you by SMS, WhatsApp, email or phone for account, order, payment, delivery, support and other service purposes. Promotional communications are subject to your choices and applicable law.

10. Availability and liability

We aim to keep the Website and its information accurate and available, but interruptions and errors may occur. To the extent permitted by law, the Website is provided as available and we are not liable for indirect or consequential losses arising from its use. Nothing in these Terms excludes or limits liability or consumer rights that cannot lawfully be excluded or limited.

11. Responsibility for misuse

You are responsible for losses, claims and reasonable costs arising from your unlawful use of the Website, your infringement of another person’s rights, or your material breach of these Terms, to the extent permitted by applicable law. We may seek appropriate remedies for such conduct.

12. Changes and termination

We may update these Terms by posting a revised version on the Website. The Terms applicable to an accepted order remain those in effect when the order was placed, except where a change is required by law. We may suspend or close an account for a material breach, fraud, misuse or legal requirement. Provisions that by their nature should survive termination will continue to apply.

13. Governing law and disputes

Indian law governs these Terms and transactions on the Website. Subject to any mandatory consumer forum or other jurisdiction available under applicable law, courts in Mumbai, India will have jurisdiction over disputes.

14. General

If a provision of these Terms is unenforceable, the remaining provisions continue to apply. A delay in enforcing a provision does not waive our right to enforce it later. You may not transfer your account or rights under these Terms without our consent. We may transfer our rights or obligations as part of a lawful business transaction, subject to applicable law.

For unresolved grievances, contact the Grievance Officer, Mosaic Wellness Private Limited, at compliance@mosaicwellness.in or 6th Floor, Thane One, DIL Complex, G.B. Road, Kapurbawdi, Village Majiwade, Thane (West), Maharashtra, India 400610. We aim to acknowledge grievances within 48 hours and resolve them as soon as practicable, ordinarily within 30 days, in line with applicable requirements.
